Intelligent Flying Machines, Inc. (“we” or “us”, dba OneTrack.AI) provides applications that permit our clients to manage their information. We respect and understand that our customers have concerns about privacy, and we take reasonable steps to ensure that any information we receive is handled in a safe and responsible manner. 

 

Important Notice About Our Applications

It is important to remember that there are public and private areas of our website and applications. Private areas are for use by registered users only. 


Our customers and registered users maintain responsibility for the use of our applications and control what data is placed within and processed by our applications. Our applications are not intended for uploading or the processing of any personal information. Intelligent Flying Machines, Inc. processes business contact information provided for particular projects in order to send automated notifications and other communications regarding the status of projects being managed by our customers within the application. 


Please also remember that by using our website or any of our applications, you agree to the terms of this Privacy Policy.

 

Personal Information Collected as Part of Delivering Our Services

Registered users or designated system owners inside their employers provide us with contact information for the purposes of delivering contracted services to you or your employer. By providing us this information, it permits us to contact you regarding our services, our applications and the status of projects you are participating in. The lawful basis for processing this data is that it is necessary for the performance of a contract between Intelligent Flying Machines, Inc. and your employer. Our applications are not intended to manage personal information within content uploaded to the application. To the extent you would like to delete personal information contained in content uploaded to our applications, it is up to the registered user to submit a support request to Intelligent Flying Machines, Inc. to delete the content. Personal information collected as part of delivering our services is retained pursuant to the contracts between the parties.

How and Why OneTrack.AI Uses Personal Information

The only personally identifiable information collected on our website and applications is submitted to us freely and deliberately by site users. Typically, this information is limited to just the data needed to respond to your request for our services: name, contact information, and employer information. The lawful basis for processing this data is the explicit consent given by you. We collect and use this information in the following ways:

If you request information about our services using a web form, you will be asked to submit your contact information, and other information about your needs, as part of the form. We will use your contact information to get in touch with you. We will use project-related information you provide to customize the information about our services that we provide to you. We may tie your personal information to web visit information we have about you for the purpose of refining our website and marketing plans and to customize the content we present to our visitors. We may combine information obtained offline with information obtained online or through our interactions with you to maintain one profile. If you would like us to delete your personal information from our records (which does not include information contained within our applications), we will do so. Personal information collected as part of delivering our services is retained until you request to be removed.

Legal Basis for Processing

Certain jurisdictions require lawful justification for the collection and processing of personal data. OneTrack.AI collects and processes personal data on the legal grounds of:

  2. The performance of a relevant contract concluded with OneTrack.AI;

Sharing Information with Third Parties

We may release personal information and web visit information when we believe it is appropriate to comply with the law, to enforce our legal rights, or to protect the rights and safety of our customers, users, or others. We only release information to third parties as necessary to provide services to our customers, but these third parties will be bound by confidentiality agreements, and will be permitted to use the information only for the purpose of providing their services for us. OneTrack.AI shares data securely and only when absolutely necessary. Your data will never be sold to external parties or organizations for marketing purposes. 

 

Personal Data Rights & Control

Depending on your jurisdiction and applicable law, you have certain rights in relation to your personal data. For instance, you have the right to obtain a copy of your personal data held by OneTrack.AI, as well as to revise and erase it partly or wholly. You can also restrict or object to the use of your personal data, as well as request the personal data you provided to OneTrack.AI to be moved to another organization.

Especially residents of the European Economic Area (EEA) and United Kingdom (UK) have the following rights under the EU Regulation 2016/679 and the UK Data Protection Act 2018 (collectively GDPR). You have:

  • The right to be informed in a clear, transparent and easily understandable way about the personal data OneTrack.AI holds, how OneTrack.AI uses your data as well as your rights. This is the purpose of this Privacy Notice.

  • The right to access your personal data, so that you are aware and can confirm that OneTrack.AI is using your data according to the data protection laws.

  • The right to rectification; meaning you are entitled to have your personal data corrected or amended if it is no longer inaccurate or incomplete or, as the case may be, if it is collected in violation of the EU-US Data Processing Framework and UK Extension to the EU-U.S. DPF.

  • The right to erasure, or else “the right to be forgotten”. This means that, subject to certain exceptions, you can request the deletion or removal of your personal data where there is no compelling reason for OneTrack.AI to keep using it.

  • The right to restrict the further processing of your personal data. When processing is restricted, OneTrack.AI can still store your personal data, but may not use it further. OneTrack.AI maintains a list of people who have asked for the “block” of further use of their data to make sure the restriction is respected in the future.

  • The right to data portability. This means that, subject to certain exceptions, you can obtain and reuse your personal data for your own purposes across different organizations.

  • The right to object to the processing of your personal data, including the right to object to certain types of processing, and you may change your preferences at will.

  • The right to lodge a complaint about the way OneTrack.AI handles or processes your personal data with your respective data protection regulator.

 

Irrespective of jurisdiction, if you have provided your consent to the use of your personal data for a specific purpose, you have the right to withdraw your consent for that specific use at any time. OneTrack.AI will no longer use your data for the purpose(s) you originally agreed to, once OneTrack.AI receives notification that you have withdrawn your consent. This, however, does not mean that the use of your personal data by OneTrack.AI with your consent up to that point is unlawful. You can withdraw your consent to the processing of your personal data at any time.

International Data Transfers

OneTrack.AI safeguards all personal data received from the European Economic Area (EEA) and the United Kingdom (UK) and which is regulated by the GDPR. OneTrack.AI is committed to protecting such GDPR personal data in accordance with its obligations under applicable law, including GDPR Articles 45 to 50, and the EU-U.S. Data Privacy Framework Principles and the and UK Extension to the EU-U.S. DPF.

OneTrack.AI takes measures to ensure your data is transferred and treated securely with appropriate safeguards and controls in place that comply with applicable laws, including the EU GDPR and the UK’s International Data Transfer Addendum. OneTrack.AI exercises due diligence in selecting the recipients of data across international borders and requires, through appropriate contractual measures (such as European Commission Standard Contractual Clauses), that they comply with adequate organizational and technical security measures to protect personal data and process them only in accordance with the instructions of OneTrack.AI and not for other purposes.

In case OneTrack.AI transfers personal data to a third-party acting as a controller, OneTrack.AI will comply with the Notice and Choice Principles. OneTrack.AI will enter into an agreement with the said third-party (acting as controller) according to which personal data may only be processed for limited and specified purposes consistent with the consent provided by you, and the third-party will provide the same level of protection as is provided by the Principles and will notify OneTrack.AI if it makes a determination that it can no longer meet this obligation. The agreement shall also provide that when such a determination is made the third-party will cease the processing or will take other reasonable and appropriate steps to remediate.

In case where OneTrack.AI transfers personal data to a third-party acting as an agent (processor for purposes of GDPR), OneTrack.AI will: (i) transfer such data only for limited and specified purposes; (ii) ascertain that the agent is obligated to provide at least the same level of privacy protection as is required by the Principles; (iii) take reasonable and appropriate steps to ensure that the agent effectively processes the personal data transferred in a manner consistent with the OneTrack.AI’s obligations under the Principles; (iv) require the agent to notify OneTrack.AI if it makes a determination that it can no longer meet its obligation to provide the same level of protection as is required by the Principles; (v) upon notice, including under (iv), will take reasonable and appropriate steps to stop and remediate unauthorized processing; and (vi) provide a summary or a representative copy of the relevant privacy provisions of OneTrack.AI’s agreement with that agent to the U.S. Department of Commerce upon request.

OneTrack.AI complies with the protection obligations covering personal data it receives under the Data Privacy Framework Principles, including the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF, and subsequently transfers to a third-party. When OneTrack.AI performs an onward transfer of your personal data received under the Data Privacy Framework Principles, OneTrack.AI shall remain responsible for the processing of your data. In particular, OneTrack.AI will remain liable under the Data Privacy Framework Principles if a recipient of your protected personal data processes such data in a manner inconsistent with the Data Privacy Framework Principles, unless OneTrack.AI is able to prove that OneTrack.AI is not responsible for the event giving rise to the damage.

Personal Data Retention

OneTrack.AI retains personal data for as long as it is considered necessary for the purposes for which the data was collected. Personal Data are retained according to the Data Retention Policy of OneTrack.AI. Applicable laws and regulations may require OneTrack.AI to keep records for specific periods of time, subject to certain exceptions. We may also need to keep records in order to administer the insurance relationship, to fulfill our contractual or statutory obligations or to resolve queries or disputes which may arise.

Security

We store and process personal information in our Cloud on servers and computers we control in the U.S. We use technical and administrative security measures intended to reduce the risks of loss, misuse, unauthorized access, disclosure and alteration. Some of the safeguards we use are firewalls and data encryption, physical access controls to data centers, and information access authorization controls. Web visit information and personal information you submit via a web form is stored on secure servers.

 

Children’s Online Privacy Protection

Our products and services are not designed for or directed to children under the age of 13, and we will not intentionally maintain information about anyone under the age of 13.

 

Sub-Processors

Intelligent Flying Machines, Inc. ensures that any vendor who is a sub-processor adheres to the same security standards as Intelligent Flying Machines, Inc. for the protection of the security, confidentiality and integrity of your personal data and against unauthorized access to or alteration, disclosure, destruction or loss. Intelligent Flying Machines, Inc. engages with the following vendors as sub-processors in the delivery of our cloud services:

  • Amazon Web Services: cloud infrastructure and services

  • Google Analytics: business analytics

  • HubSpot: CRM and communication services

Data Privacy Framework

OneTrack.AI complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF as set forth by the U.S. Department of Commerce.  OneTrack.AI has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EUU.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles, the Principles shall govern. As a participant in the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF, OneTrack.AI is subject to the investigatory and enforcement powers of the Federal Trade Commission (FTC).

In compliance with the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF, OneTrack.AI commits to resolve DPF Principles-related complaints about our collection and use of your personal information.  EU and UK individuals with inquiries or complaints regarding our handling of personal data received in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF, should first contact OneTrack.AI at privacy@onetrack.ai

OneTrack.AI has further committed to refer unresolved complaints with regard to Personal Data other than human resources data to International Centre for Dispute Resolution, International Division American Arbitration Association (“ICDR-AAA”), an alternative dispute resolution provider located in the United States. If you do not receive timely acknowledgment of your complaint from us, or if we have not resolved your complaint, please contact or visit https://go.adr.org/dpf_irm.html and www.dataprivacyframework.gov for more information or to file a complaint.  The services of the ICDR-AAA are provided at no cost to you.

The Federal Trade Commission has jurisdiction over compliance with the EU-U.S. DPF and UK Extension to the EU-U.S. DPF for OneTrack.AI.

If your complaint cannot be resolved through the above channels, under certain conditions, you may invoke binding arbitration for some residual claims not resolved by other redress mechanisms as provided in the EU-U.S and UK extension.

In the context of an onward transfer, OneTrack.AI has responsibility for the processing of Personal Data it receives under privacy principles including the EU-U.S. DPF and UK Extension to the EU-U.S. DPF, and subsequently transfers to a third party acting as an agent on its behalf. OneTrack.AI shall remain liable under the Principles if its agent processes such personal information in a manner inconsistent with the Principles, unless the organization proves that it is not responsible for the event giving rise to the damage.

Changes to Policy

We may change this Privacy Policy from time to time. If so, any such changes will be posted on this page and we will note the date the Privacy Policy was most recently revised. We recommend that you review this Privacy Policy on a regular basis. Your continued use of the site shall constitute your acceptance of such revised Policy.
